TERMS OF SERVICE
Stevenson Ridge-Halcyon Community Association App
Effective Date: May 24, 2026
1. AGREEMENT TO TERMS
By accessing and using the Stevenson Ridge-Halcyon Community Association App ("App"), you agree to be bound by these Terms of Service ("ToS"). If you do not agree to these terms, do not use the App.
These ToS apply to all users, including residents, members, administrators, and security officers. By using the App, you acknowledge that you have read, understood, and agree to be bound by all provisions of this agreement.
2. ELIGIBILITY
By using the App, you represent and warrant that:
- You are at least 18 years of age
- You are a resident of Maryland
- You are a resident of the Stevenson Ridge-Halcyon community
- All information you provide is true, accurate, and complete
- You will maintain the confidentiality of your username and password
We reserve the right to refuse service to anyone who violates these terms or our privacy policies.
3. USER ACCOUNTS AND MEMBERSHIP
Account Creation
When you register, you create an account with an initial "Resident" status. You may upgrade to "Member" status by enrolling and paying the association's membership dues.
You are responsible for:
- Maintaining the confidentiality of your password
- All activities that occur under your account
- Notifying us immediately of unauthorized access
- Updating your profile information if it changes
Membership
Membership is optional and voluntary. Member benefits include:
- Submission of security service requests (security concerns, escort requests, home checks)
- Access to member-only documents and content
- Participation in community features designated for members only
By becoming a Member, you agree to:
- Pay the association's membership fees as set by the board
- Comply with all community association rules and policies
- Use membership benefits responsibly and in good faith
- Not misrepresent your information or use false pretenses to obtain member status
The board reserves the right to deny, revoke, or suspend membership for violation of community rules or misuse of the App.
Account Termination
You may request termination of your account at any time. Upon termination:
- Your personal profile data will be deleted within 6 months
- Security logs and incident reports related to your requests will be retained for 3 years for record-keeping and governance purposes
- You will lose access to member-only features and content
- Your membership status and any associated dues payments will be terminated
4. USER CONDUCT AND RESPONSIBILITIES
Prohibited Conduct
You agree not to:
- Use the App for any illegal purpose or in violation of any applicable law
- Submit false, misleading, or fraudulent information
- Impersonate another person or falsely claim association with a person or entity
- Harass, threaten, or abuse other users, staff, or security personnel
- Submit service requests that are frivolous, malicious, or not in good faith
- Attempt to gain unauthorized access to the App, its systems, or other users' data
- Reverse engineer, modify, or create derivative works of the App
- Transmit malware, viruses, or any code intended to disrupt the App
- Engage in any conduct that disrupts or degrades the quality or functionality of the App
Service Request Conduct
When submitting a service request:
- You agree the information is true and accurate to the best of your knowledge
- You authorize security personnel and the board to respond to your request
- You agree not to submit requests that are false alarms, pranks, or made in bad faith
- You understand that false or frivolous requests may result in loss of service request privileges
- You agree to cooperate with security personnel responding to your request
Community Content
You agree not to post, upload, or transmit:
- Content that is defamatory, hateful, threatening, or abusive
- Content that violates the privacy or intellectual property rights of others
- Spam, advertisements, or commercial content
- Content that is obscene, graphic, or otherwise inappropriate for a community audience
5. SECURITY OPERATIONS AND OFFICER PROTECTIONS
Security Logs and Incident Reports
Security officers and authorized personnel maintain logs of incidents, patrols, and responses to service requests. By using the App and submitting service requests, you understand and agree that:
- Security logs and incident reports are created in the normal course of community safety operations
- These logs are maintained for community record-keeping, operational continuity, and governance purposes
- Log entries reflect the officer's observations, assessments, and actions at the time of the incident
- Officers act in their professional capacity and in good faith to serve the community
Security Officer Actions and Decisions
You acknowledge that:
- Security officers make operational decisions in real-time based on available information
- Officers are trained to assess situations and respond appropriately
- Decisions made during emergency or urgent situations may be made quickly and with incomplete information
- The App facilitates record-keeping but does not replace officer judgment or professional training
- The board provides oversight of security operations and policies
Limitations on Liability for Security Operations
To the fullest extent permitted by law, you agree that:
- Neither security officers, individual board members, nor the association shall be liable for damages arising from security operations, incident responses, or security decisions made in good faith
- This includes, but is not limited to, damages from delayed response, inability to respond, misunderstandings, miscommunications, or operational constraints
- You assume the risk of using the security service request feature and understand that no response time or outcome is guaranteed
However, this limitation does not apply to gross negligence, willful misconduct, or violations of law.
6. CONTENT OWNERSHIP AND INTELLECTUAL PROPERTY
Association-Owned Content
All documents, alerts, announcements, and other content published by the association through the App ("Association Content") are owned by the Stevenson Ridge-Halcyon Community Association. You may view and download Association Content for personal use only.
You may not reproduce, distribute, modify, or republish Association Content without written permission from the board.
User-Submitted Content
When you submit information to the App (service requests, uploads, communications), you grant the association a non-exclusive license to use that content for the purposes of operating the App and serving the community.
You retain ownership of your personal information and can request deletion as outlined in our Privacy Policy.
Trademarks
The Stevenson Ridge-Halcyon Community Association name, logo, and all related marks are trademarks of the association. You may not use these marks without written permission.
7. LIMITATION OF LIABILITY
App Provided "As Is"
The App is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. The association does not warrant that:
- The App will be uninterrupted, error-free, or secure
- The App will meet your specific needs or expectations
- Defects or errors will be corrected
- The App is free of viruses or malware
Disclaimer of Warranties
To the fullest extent permitted by law, we disclaim all implied warranties including merchantability, fitness for a particular purpose, title, and non-infringement.
Limitation of Damages
To the fullest extent permitted by law, in no event shall the association, its board members, officers, employees, or security personnel be liable for:
- Indirect, incidental, special, or consequential damages
- Lost profits, data loss, or business interruption
- Damages arising from your use of or inability to use the App
- Damages from unauthorized access or alteration of your data
- Any damages exceeding the amount you have paid (if any) to use the App in the past 12 months
This limitation applies even if we have been advised of the possibility of such damages.
Exceptions
These limitations do not apply to:
- Our indemnification obligations
- Gross negligence or willful misconduct
- Violations of law that cannot be limited by law
- Maryland law requirements that cannot be waived
8. INDEMNIFICATION
You agree to indemnify and hold harmless the association, the board, officers, employees, and security personnel from any and all claims, damages, losses, costs, and expenses (including attorneys' fees) arising from:
- Your use of the App
- Your violation of these ToS or any law
- Your violation of any community association rules
- Disputes with other residents or members
- Your user-submitted content or information
- Your service requests or communications
This indemnification applies even if the claim arises partly from the association's actions or negligence, except where prohibited by law.
9. DISPUTE RESOLUTION
Informal Resolution
Before pursuing formal dispute resolution, the parties agree to attempt informal resolution by contacting the association board.
Arbitration
Any dispute arising from or relating to these ToS or your use of the App shall be resolved by binding arbitration in Maryland under the rules of the American Arbitration Association (AAA).
By agreeing to arbitration, you waive the right to:
- A jury trial
- Bring a class action claim
- Obtain court injunction
The arbitrator's decision is final and binding and may be enforced in any court of competent jurisdiction.
Exceptions to Arbitration
Notwithstanding the above, disputes related to intellectual property rights and claims seeking injunctive relief may be brought in court.
10. MODIFICATION AND TERMINATION OF THE APP
Board Authority
The board of the Stevenson Ridge-Halcyon Community Association has full authority to:
- Modify, update, or change the App and its features at any time
- Modify these ToS and our Privacy Policy
- Suspend or terminate the App entirely
- Limit access to certain features or content
Notice of Changes
When we make material changes to these ToS, we will provide notice through the App or via email to registered users at least 30 days before the changes take effect (unless a change is necessary for security or legal compliance, in which case it is effective immediately).
Your continued use of the App after changes become effective constitutes acceptance of the modified ToS.
App Termination
If the board determines that the App is no longer serving the community's needs, the board may terminate the App entirely. In such case:
- The board will provide notice to all active users
- Users will have a reasonable period (not less than 30 days) to download or export their personal data
- After that period, all user data will be deleted in accordance with our retention policies
- The association will not be liable for any damages resulting from app termination
11. THIRD-PARTY LINKS AND CONTENT
The App may contain links to third-party websites or services (email providers, payment processors, etc.). The association is not responsible for the content, accuracy, or practices of these third parties.
Your use of third-party services is governed by their terms and privacy policies. We encourage you to review them independently.
12. PRIVACY
Your use of the App is also governed by our Privacy Policy. Please review it in conjunction with these ToS.
13. GOVERNING LAW AND JURISDICTION
These ToS are governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict-of-law principles.
The exclusive jurisdiction for any legal proceedings not subject to arbitration is the state and federal courts located in Maryland.
14. SEVERABILITY
If any provision of these ToS is found to be invalid or unenforceable, that provision will be severed and the remainder of these ToS will remain in full force and effect.
15. ENTIRE AGREEMENT
These ToS, together with our Privacy Policy, constitute the entire agreement between you and the association regarding your use of the App and supersede all prior and contemporaneous agreements, understandings, and communications.
16. CHANGES TO THESE TERMS
We may modify these ToS at any time. If we make material changes, we will notify users through the App or email at least 30 days in advance. Your continued use of the App after changes are effective constitutes acceptance of the modified ToS.
If you do not agree to the modified ToS, you must stop using the App and request account termination.
